The club contacted the player to show him all their support in these difficult moments, as has become customary in these types of situations that, unfortunately, the Argentine has had to experience. Leo Messi lives delicate moments by the judicial setback. Now he is on vacation and at the end of the month he plans to rejoin the discipline of Luis Enrique’s team.
The prosecutor has asked the Supreme Court to confirm the sentence of 21 months in prison, which the Barcelona Court imposed on the footballer Lionel Messi, in the brief that he has presented before the magistrates of the high court for their deliberation on the resources of the player and his father.

Prosecutors ask Supreme Court to confirm Messi prison sentence
The Supreme Court has reviewed today, in a closed-door deliberation, the resources that the footballer Leo Messi and his father presented against the sentences for tax crimes -21 months in jail for each one- imposed on them by the Barcelona Court for tax fraud.
The Court condemned the Argentine international and his father for having defrauded the Treasury 4.1 million through a network of intervening companies.
The Supreme Court must decide whether or not to confirm those sentences or, where appropriate, whether or not to vary the penalties imposed. The court has studied the matter but has not released the ruling until the sentence is notified in the next few days.
One of the factors that the court takes into account is the position of the prosecutor and he considers that Messi "must be held responsible for the tax crimes for which he has been convicted because he could not ignore that he had to declare and pay taxes on the sums he received" in exchange for the exploitation of their image rights.
The brief that the prosecutor has presented before the Criminal Chamber of the high court also considers that the conviction of Messi for three crimes of tax fraud is based "on validly proven data" and in "a motivation that is neither illogical nor arbitrary".
In the event that the Supreme Court confirms the sentences in their entirety, the inmates could avoid jail, as the sentences are not greater than two years. But that would depend on the Audiencia, which could also send them to prison.
The Barcelona audience reproached Messi for opting for a "deliberate ignorance" on the management of their income from the exploitation of their image rights, before the "justified suspicion" that the corporate structure it used was not "clear and sharp".
"For theoretical purposes"says the prosecutor, "the hypothesis that the taxpayer can act fully relying on the indications of the person giving legal advice is imaginable and not extravagant", as the Supreme Court has collected in its jurisprudence on cases similar to the one reviewed this Thursday.
Even so, and since essi signed before a notary public that he knew the content of the fictitious contracts and other acts of simulation or concealment, the Barcelona Court has not violated his presumption of innocence by appreciating that he acted with serious indifference wanting to remain in ignorance without access information that was relevant, he adds.
"Messi intervened directly in the contracts related to the exploitation of his image rights and was the administrator and sole partner of the company that received the income", also recalls the prosecutor.
One of the reasons alleged by Messi’s defense was directed against a phrase, collected in the judgment of the Hearing: "Impunity in these cases sends the message to the public that it is preferable to inhibit than to worry".
"The transcribed phrase cannot be considered, in any case, violating the dignity of the accused"answers the prosecutor’s letter.
In addition, the soccer player’s defense attorneys alleged that it has not been proven that his sponsor was the author of the concealments detected in his tax returns, which were presented by his advisers.
In this regard, the prosecutor’s letter indicates that, although he did not accuse Messi, but only his father Jorge, after "examine whether the judgment under appeal offers, as a whole, the essential elements of judgment", consider that it does: "The authorship judgment has relied on enough evidence and this has been rationally assessed".
Furthermore, it denies that the three years that elapsed from the complaint to the trial represent an undue delay that must be taken into account to lessen the penalties for that reason.
Nor, he says, should Messi be favored by the fact that the accusation was raised when some of the crimes were about to expire.
The footballer was punished for three crimes of fraud to the Treasury committed between 2007 and 2009. The penalty is only one year and nine months in prison because the court took into account the mitigating compensation for damage, despite which it imposed a fine 2 million euros to the footballer and 1.5 million euros to his father.
The economist Luis Garicano was recently chosen by the Citizens executive to take over one of the vice presidencies of the Party of the Alliance of Liberals and Democrats for Europe (ALDE) and in an interview with ‘El Español’ he did not hesitate to return the focus on Leo Messi despite the fact that the Argentine star was already condemned for his irregularities with the treasury.

Citizens harsh attack on Messi which forgot about Ronaldo
"In the world of football we have found that there is a huge fraud situation and nobody ends up in jail here. Messi in the US would be in jail right now. In Spain it is practically impossible to end up in jail for a tax offense. Ultimately, effective and efficient sanctions are very important to enforce the law"Garicano assured.
However, Luis Garicano himself obviated in the response to a Cristiano Ronaldo who was recently uncovered in the case ‘Footbal Leaks’ had diverted at least 150 million to a tax haven to hide income from image rights. The newspaper ‘El Mundo’ revealed that the Portuguese Real Madrid player was being investigated by the Treasury for his income statements between 2011 and 2013.
The trial of Leo Messi and his father and subsequent sentence to 21 months in prison for three tax offenses between 2009 and 2011 has its own name, due to the relevant role it has played throughout the entire process. The State Attorney, Marta Silva Lapuerta, has generated controversy over her Madrid past.

While the Prosecutor’s Office did not see reasons to accuse the Argentine, the State Attorney became the only party that requested a sentence for the Barça player, despite declaring that it was not aware of any of the operations that were carried out with his money.
Marta Silva Lapuerta is the head of the State Legal Service, that is, the person responsible for deciding whether the State is involved in a case as a private prosecution, as it did in the Argentine trial.
Curiously, the same person who decided that Messi should sit on the defendant’s bench, found no reason to judge Infanta Cristina in the ‘Case Nóos’, considering that the King’s sister was unaware of the actions of her husband Iñaki Urdangarín.
The same argument was interpreted in two opposite ways by Marta Silva. The State Attorney was implacable in the trial of Messi and in the Neymar case and much more lax on other fronts. But perhaps his decisions were not accidental, based on the Madridista past of the State Attorney.
The daughter of a former Francoist minister, Silva was a director of Real Madrid and a person of the highest confidence of Florentino Pérez between 2000 and 2006. Later, also through the mediation of the ‘almighty’ white president, she got a position as a high position in the construction company Sacyr between 2003 and 2009.
It is also curious that, in the ‘Bárcenas papers’ there were payments in B from the construction company to the PP treasury during Silva’s time. Notwithstanding, the State Bar refused to appear as an accusation.
Another of the 1xbet.login images that damaged Silva’s credibility occurred in March 2014, when with the Neymar case already on the table, Florentino Pérez invited Silva to the Bernabéu box to attend the classic against FC Barcelona.
The Supreme Court reviews this Thursday, in a deliberation to be held behind closed doors, the appeal that the footballer Leo Messi and his father have presented against the sentence to 21 months in prison for each one that the Barcelona Court imposed on them for tax fraud.

The Provincial Court of Barcelona condemned the Argentine international and his father for having defrauded the Treasury 4.1 million through a network of intervening companies. The Supreme Court must decide whether or not to confirm those sentences or, where appropriate, whether or not to vary the penalties imposed.
Even in the event that the Supreme Court confirms the sentences in full, both could avoid jail, as the penalties are not greater than two years, as long as the Court so agrees, which could also send them to prison.
In any case, the truth is that the judicial calendar will intersect with decisive dates for the player’s sporting exercise: after the Champions League game against Juventus in Turin and three days before the classic against Real Madrid at the Madrid Bernabéu.
